These terms and conditions (hereinafter referred to as the "Terms") define the terms of the contractual relationship between (trade name of the company), holder of ICE No. X and with its registered office located at X (hereinafter referred to as "Carloue"), and any user of the car rental services offered on the web platform https://www.carloue.ma (hereinafter referred to as "the Platform"). By accepting to use the services of the Platform, the User acknowledges having read, understood, and accepted these Terms without reservation.
The Terms and Conditions applicable to any rental are those in effect at the time of the conclusion of the rental agreement, as displayed on the Platform. Upon registration on the Platform, the User was informed of the existence and content of the Terms and Conditions, which they had to accept to finalize their registration. The User confirms having read the Terms and Conditions before confirming the rental, and this confirmation constitutes a complete and unconditional acceptance of the Terms and Conditions. In case of disagreement with these conditions, the User must refrain from using the services offered by Carloue.
Welcome to Carloue! We thank you for taking the time to carefully read our terms of use and service (TOS). They contain crucial information regarding your rights, obligations, as well as applicable limitations and exclusions. These TOS constitute a legally binding agreement between you and Carloue, governing your access and use of the Carloue.ma website (the "Site"), our mobile, tablet, and other smart device applications (the "Application"), as well as all associated services (collectively, the "Services"). Together, the Site, the Application, and the Services form the "Platform."
Carloue acts as an intermediary by connecting users looking to rent a vehicle with those who want to rent out their vehicle(s). Our role is to provide a secure and user-friendly platform to facilitate this connection.
It is important to note that rentals are governed by these TOS and are supplemented by the Rental Agreements, as specified in our terms. You can only avail yourself of the services offered by Carloue if you comply with the TOS and the terms of the Rental Agreement.
We collect and use personal data related to your access and use of the Platform, in accordance with our privacy policy. We are committed to ensuring the confidentiality and security of your personal information.
By accepting to use our services, you acknowledge that you have read, understood, and fully accepted these TOS without any reservations. If you disagree with these conditions, we recommend refraining from using the services offered by Carloue.
To access and use the Platform, the user must be a natural or legal person capable of entering into legally binding contracts. By registering, users create an account with a username and password. They are responsible for their account usage until they notify Carloue of any loss or disclosure.
Lessees and lessors must accept the TOS (Terms of Service).
Conditions for Lessors: Individuals must be at least 18 years old and provide a valid identification document, a valid insurance certificate, as well as a vehicle registration sticker and card that are compliant with the vehicle being rented out. Professionals must provide their company information, including their registration number with the commercial registry.
Conditions for Lessees : Lessees must be registered under their true identity, hold a valid driver's license for at least two years, have a valid electronic payment method, and provide all required information, including proof of address.
Users agree to provide accurate and up-to-date information. Each user can only have one personal account and cannot use someone else's information. Carloue strives to ensure the accessibility of the Platform but cannot guarantee continuous access. The Platform may be subject to updates or interruptions for technical reasons, without any liability on the part of Carloue.
The User is required to inform Carloue immediately upon discovering any unauthorized use of their account. While Carloue strives to maintain continuous accessibility of the Platform, factors associated with Internet usage may result in malfunctions and delays. Therefore, Carloue cannot guarantee uninterrupted access to the Platform and its associated services. However, we take all reasonable measures to minimize disruptions and restore normal operation of the Platform as quickly as possible.
Updates or patches may also result in temporary suspensions of access to the Platform, without any liability on the part of Carloue in this regard. Please note that 24/7 availability of the Platform is not guaranteed, and Carloue cannot be held responsible for any inability to access the Platform.
To create a listing, lessors must answer questions about the specific vehicle, such as its location, age, features, availability, and rental price, on the Site/Application. Lessors can only rent vehicles based on the information provided in the listing and cannot request a price higher than the recommended reference price by Carloue. Lessors are responsible for their listings, and Carloue reserves the right to refuse or exclude any listing that does not comply with the TOS. Additionally, vehicle listings that have been inactive for an extended period may be deactivated. Lessees select a vehicle based on the available price and location on the platform.
Only vehicles that meet the following criteria can be listed on the Site/Application: they must have a valid permanent registration (carte grise) and comprehensive insurance coverage. Carloue reserves the right to accept or refuse a vehicle based on technical criteria such as its age or mileage.
Regarding identity verification, Carloue conducts verifications but does not guarantee the Users or the Vehicles. Users must provide accurate information and acknowledge that any liability or legal recourse against third parties is limited to those third parties themselves, and agree not to hold Carloue responsible.
Lessor identity verification involves submitting their identification document, a valid insurance certificate, a permanent vehicle registration (carte grise), and photos of the vehicle showing its registration. As for Lessee verification, it requires a front/back photo of their driver's license, a photo of their identification document, and proof of address. Payments to the Lessor are suspended until confirmation of the vehicle's handover by the Lessee. Furthermore, the Lessor has the right to refuse the rental if the person picking up the vehicle is not the Lessee.
The Lessee browses Lessor Listings on the Site or Application and can submit a booking request. If the Lessor accepts, the payment made by the Lessee is processed by the Site/App. Rentals are governed by the TOS and supplemented by Rental Agreements, which can be in paper or electronic form through the Application. Prior to the start of the rental, the Lessee must verify the Lessor's identity, the vehicle's registration documents, as well as the vehicle's condition and safety equipment. The Rental Agreement must be signed by both parties before the rental begins, binding the Lessee to accept the vehicle's condition without the possibility of subsequent dispute. At the end of the rental, the vehicle is returned by the Lessee. The Lessee and Lessor then inspect the vehicle's condition, note the mileage and fuel level, inspect for any damages, take photos of the vehicle, and complete and sign the end-of-rental report. After the return, Users can mutually rate each other on the Site/App to share their customer experience, with the understanding that Carloue may remove reviews containing inaccurate information. Users can also exchange messages via the integrated messaging system on the Platform, but these exchanges are private and not published on the Site/App.
The Lessee and Lessor have the option to cancel a reservation made on the Site/App at any time before payment. The Lessee has a 48-hours window prior to the reservation start time and date to cancel it. After this period, payments are automatically processed to the Lessor's benefit.
The Lessee authorizes Carloue to charge the credit card used for the rental payment for any amount due to the Lessor, acting on behalf of and for the account of the Lessor. Carloue processes these transactions in collaboration with the Interbank Monetic Center to collect the funds collected through the Platform.
A pre-authorization is a temporary hold of funds on a credit card. These funds are not immediately debited from the bank account but may appear temporarily on the Lessee's bank statement, depending on the policy of the card issuer bank.
This pre-authorization is done at the time of vehicle reservation, for an amount equivalent to the total rental fee. However, if the Lessee formally cancels the rental up to 48 hours before the vehicle pickup date, the pre-authorization will expire, and the reserved funds will be released back to their account.

Users can unsubscribe from the Platform and delete their account at any time by sending a request via email to contact@carloue.ma
In certain circumstances, including non-compliance with the obligations arising from these TOS, payment incidents, provision of incorrect information during the account creation, or actions detrimental to the interests of Carloue, the latter reserves the right to suspend or delete the User's account.
Compliance by the User with the obligations set forth herein is an essential condition for the agreement of these TOS. Therefore, Carloue reserves the right to immediately suspend the User's access to the Site/Application and Services, or even terminate their Account, if the User fails to comply with their obligations, without prior notice. This does not exclude the possibility of seeking damages or pursuing other remedies against the User.
All data, software, domain names, databases, and other elements related to the Platform are the exclusive property of Carloue, protected by various intellectual property rights. Any use of the Platform, including its source code or object code, images, icons, or descriptions, is prohibited without the explicit consent of Carloue.
Carloue disclaims any responsibility for errors in user-entered contact information, misuse of credentials or the ordering process, as well as obvious errors in displaying extremely low prices. Furthermore, in the event of failure to deliver the vehicle due to the User, a third party, or a force majeure event, Carloue's liability is also excluded.
Furthermore, Carloue only assumes a best-effort obligation in all stages of online payment and does not accept any responsibility for technical errors or any direct or indirect damages resulting from the use of the platform. Users also acknowledge that Carloue has fulfilled its obligations of providing information regarding the platform.
In the event of malfunctioning of the website or service caused by the User, a third party, or force majeure, the User is responsible and must take measures to protect their data.
Furthermore, Carloue does not guarantee the solvency of users, as it solely facilitates the connection between Lessors and Lessees, and is not held responsible for any damages caused by them. Lastly, Carloue does not provide any rental income guarantees.
The Site and Services are generally accessible 24 hours a day, 7 days a week, except in cases of force majeure or unforeseen events beyond Carloue's control, as well as during outages or maintenance and update operations necessary to ensure the proper functioning of the Site and the provision of the Service (hereinafter referred to as "Maintenance Operations"). Users should be aware that the Site and Service may be temporarily suspended to perform these Maintenance Operations. In such cases, Carloue is committed to informing Users as soon as possible.
In the event of a malfunction or anomaly disrupting the proper functioning of the Site or the provision of the Service, Carloue undertakes to take all necessary measures to restore the operation of the Site and/or the Service as soon as possible. It is important to note that any difficulties related to the User's Internet access or computer hardware are not covered by this assistance.
Users do not have the right of withdrawal as provided for in distance contracts, in accordance with Article 42 of Law 31-08 on consumer protection measures.
Carloue is responsible for the processing of your personal data that is collected when you use our Services and our Site in accordance with applicable legal provisions. This means that Carloue is responsible for the collection, security, and use of your personal data for the purposes detailed in our Privacy Policy, in compliance with data protection rules. By registering as a User, you consent to this processing and guarantee the accuracy of all data you provide to us.
The User must comply with the General Terms and Conditions (GTC) as well as the applicable laws and regulations in order to benefit from the Service. Carloue reserves the right to withdraw access to the Service at any time if the User fails to comply with their obligations. Additionally, Carloue may suspend access to the Service in the event of non-compliance with the GTC, violation of the rights granted therein, or in case of intrusion or compromise of the integrity of the Site. Any breach of the GTC, observed fraud or attempted fraud, as well as any misconduct, may result in the User being placed on an exclusion list. Users registered on this list will no longer be able to rent a vehicle or post rental listings on the Site or Application, and Carloue reserves the right to take legal action against these Users.
Carloue is committed to continuously improving the features and functionality of the Site, Application, and Services to ensure their proper functioning and quality. With this objective in mind, Carloue reserves the right to unilaterally make changes to the General Terms and Conditions (GTC), particularly to comply with any developments in Carloue's Services or legal, jurisprudential, editorial, and/or technical changes. In the event of modifications to the GTC, Carloue will notify Users prior to their effective date.
The applicable General Terms and Conditions (GTC) are those accessible from the Platform at the time of the rental.
These Conditions are subject to Moroccan law. In the event of a dispute relating to the interpretation or execution of these Conditions, the Parties agree to seek an amicable solution before resorting to any legal action.
Any dispute with a User that cannot be resolved amicably shall be submitted to the courts within the jurisdiction of the Court of Appeal of Casablanca.
